Terms of Use
1. Acceptance of these terms
By creating a GatiKavach account or using the GatiKavach app, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the app.
2. What GatiKavach is
GatiKavach is a family safety monitoring app with two roles: a Guardian, who registers an account and adds one or more Riders to monitor, and a Rider, whose device reports location and motion data during rides so the Guardian can see live tracking, crash detection, geofence alerts, overspeed alerts, and ride history with a safety score.
3. Accounts and eligibility
A Guardian must be an adult capable of entering into these terms. A Rider may be a minor — in that case, the Guardian who adds them is responsible for that Rider's account, for having the appropriate authority and consent to enroll them, and for reviewing this policy and the Privacy Policy on the Rider's behalf. Each account's phone number and email address must be unique and accurate; login codes are sent to the email on file.
4. A supplementary safety tool, not a guarantee
GatiKavach's monitoring, alerting and crash-detection features are supplementary aids and are not a substitute for safe riding practices, defensive riding, vehicle maintenance, or a rider's own situational awareness. Detection depends on network connectivity, GPS accuracy, and device sensors, and can be delayed, degraded, or fail entirely — for example when a device has no signal, its location services are off, or its battery is dead. We do not guarantee that any alert, including an SOS or crash alert, will be delivered or delivered in time. Do not rely on GatiKavach as a sole safety measure in place of good judgment.
5. Your responsibilities
- Provide accurate registration information and keep it up to date.
- Keep your device's location services and the GatiKavach app running so monitoring can work as intended.
- Do not use the SOS or alert features to raise false alarms.
- Do not attempt to access another user's account or data you're not authorized to see.
6. Free service
GatiKavach is provided free of charge, with no subscription fees and no advertising. We may change, suspend, or discontinue features, or the service as a whole, at any time.
7. Data and privacy
Our collection and use of your data, including location and sensor data, is described in the Privacy Policy, which is part of these terms.
8. Termination
You may stop using GatiKavach and request account deletion at any time (see the Privacy Policy for how). We may suspend or terminate accounts that misuse the service or violate these terms.
9. Limitation of liability
To the fullest extent permitted by law, GatiKavach and iWork Technologies Private Limited are not liable for any injury, loss, or damage arising from your use of, or inability to use, the app — including a missed, delayed, or failed alert — except where such liability cannot be excluded by law.
10. Changes to these terms
We may update these terms as the app evolves. Material changes will be reflected by an updated "Last updated" date above.
11. Governing law
These terms are governed by the laws of India.
